Performance Agreement Contract
This agreement is for the services of Magnetic Eagle Productions (A.K.A. TranceVideo.com and VJ Aix),
herein called "Artist" and _______________________ of
______________________________ (herein called "Client") for the engagement

undersigned Artist and Client.

By signing this agreement, client agrees to all terms of this agreement
as stated below. Client also states that he/she is at least 18 years of
age and is legally able to enter into a contract in the United States.
Deposit:
A deposit of 50% of the stated fee, plus any applicable airfare,
lodging and transportation costs shall be payable to Magnetic Eagle
Productions upon signing of this contract.
Checks or money orders shall be made payable to Magnetic Eagle
Productions and must clear prior to event. Deposit is NOT refundable if
client breaches any terms in this contract.
Final Payment:
Remainder of payment shall be made in full, in cash, the day of the
show prior to the start of the show. Artist reserves the right to
terminate show at any time if payment is not received.
Pro-rate:
If Artist must terminate show prior to the pre-agreed show stop time
due to Artist's illness or failure of Artist's equipment, Client will
be refunded difference of final payment on a pro-rated basis. Pro-rate
refund is determined by dividing final payment by hours of show
remaining. If show must be terminated prior to the pre-agreed show stop
time due to any other reason, final payment is NOT refunded nor
pro-rated.
Venue:
Client agrees to disclose an exact, accurate location of venue upon
entering contract, which will be held in strict confidentiality. Client
agrees to allow Artist to survey the venue prior to show. Client
assures Artist that venue is 100% legal and all necessary permits,
clearances and permissions are in place. Artist reserves the right to
decline to setup at a venue for any reason.
Site Requirements (Provided by Client):
Power - Two outlets providing 110 VAC 15amp (3000 watts) of steady,
clean, grounded power (in the US) within 100 feet of video control area
including Generator / Power Source if needed. Contact Artist regarding
power at events outside the USA.
Physical - If indoors, at least a 6' x 12' spot for the video control
area. If outdoors, a vehicle or tent serves as the control area to
protect equipment from the elements. In either case, the control area
must be situated no further than 50 feet from the projector, which is
usually approx. 20 - 70 feet from the screen or surface to be projected
on. Areas shall be so located and setup as to protect equipment and
operator from crowd, weather or other potential safety hazards.
Equipment (provided by Magnetic Eagle Productions):
(1) Video mixer, (2) multiple miniDV camcorders, (3) original video
mixes on digital video tape, (4) screens and projectors are to be
determined on a case-by-case basis. Arrangements for additional
equipment need to be made at least 7 business days in advance.
Additional charges may apply.
Typically, a projection screen is deployed behind, above, or adjacent
to the stage. Many venues have potential for various creative setups,
and Artist will work with the venue and promoters to maximize the
visual effect. Due to the cost and delicate nature of equipment
involved, as well as safety concerns, Artist reserves the right to
decline an unsuitable setup.
Client may provide videos for use by Artist. Artist retains sole
discretion as to suitability and use of material. Arrangements for
custom video, logos, titles, etc. need to be made at least seven
business days in advance. Additional charges may apply.
Client agrees to be financially responsible for damages or loss to
Artist's equipment caused by improper power, vandalism, theft, fire,
accident, confiscation, unsafe venue, and reckless or unsafe actions by
anyone other than the Artist.
Client agrees to pay for services in full if event is shut down early for any reason.
Beyond the terms of this contract, Artist is not affiliated with the
promotional group, venue, or any other entities organizing this event,
and therefore cannot be held liable for any damages, injuries, fines or
other liabilities resulting from this event.
The recording, reproduction or transmission of Artist's performance is
prohibited without written consent of Artist.
